Fly Tipping Prosecution at Loughborough Magistrates Court

Janet Fennelly employed someone to take away some bags of rubbish and an old chair. However the rubbish was later found in Pavillion Way. Charnwood Borough Council then tracked the rubbish back to her.

According to the law everyone has a duty to ensure that their waste is disposed of properly and it is an offence if they fail to do so. What Janet Fennelly failed to do was to ensure that the person they employed was registered to dispose of waste by asking to see their Waste Carriers Licence and obtain a receipt for the waste (Waste Transfer Note) which should be kept for a two year period.

Janet now faces a £250 fine and has to pay £250 costs imposed by Loughborough Magistrates Court.

This is the 4th successful prosecution for the council since the beginning of September 2007.

Chris Cary, Charnwood Borough Councils Senior Enforcement Officer, added: "This is our fourth successful prosecution since the beginning of September. We will continue to actively identify and prosecute those that consider fly-tipping an acceptable practice. It is our aim to rid Charnwood of fly-tips and create a better environment for residents and visitors of the Borough.
