18 MONTH SENTENCE FOR CONTEMPT OF COURT BREACH OF ANTI SOCIAL BEHAVIOUR INJUNCTION

Last Friday Charnwood Neighbourhood Housing, in partnership with Leicestershire Police, on behalf of Charnwood Borough Council returned Daryl Eley of 22 Peel Drive to the Leicestershire County Court for the second breach of his Anti Social Behaviour Injunction.

Charnwood Neighbourhood Housing applied for an urgent injunction on22nd July 2009in response to growing concerns over the anti social behaviour of Eley. Aninterim injunction was granted but within 2 days Eley had breached the order and was given a 12 day custodial sentence.

Eley was released on 31st July but within 5 days he was arrested for further breaching the terms of the order.

In passing sentence of 18 months imprisonment HHJ Hampton said:

"I fully appreciate the impact of an upbringing such as yours and of poor parenting but at some point a line must be drawn and you must accept responsibility for your own actions. It is only one week since you were before me last and I released you. I had hoped you had learned from your short, sharp spell in custody but clearly you havent. Council tenants have had to endure your anti-social and criminal conduct which on this occasion has been aggravated by contempt of this court."

Isobel Rickard, Director of Housing Operations at Charnwood Neighbourhood Housing said,

"We are delighted that HHJ Hampton has given a sentence that re-enforces the seriousness of breaching an anti social behaviour injunction. This sentence should send a message to those that continue to behave in an anti social manner on our estates. We will not tolerate behaviour that causes our residents to live in fear and will take swift action where necessary to protect our residents right to live on estates that are free from anti-social behaviour.

Hastings Ward Team leader Police Sergeant Jamie Osborne said: "We hope that this sends out a clear message to people intent on causing anti social behaviour, that it will not be tolerated. We will continue to work in partnership with Charnwood Neighbourhood Housing and Charnwood Borough Council to ensure the residents live in a safe and pleasant environment"

Wendy Brown, ASB Co-ordinator for Charnwood Borough said, "Results like this show how seriously these mattered are taken, both by partner agencies and the Courts. We will continue to target individuals like Eley, in order to ensure that local residents are able to move freely around their communities without fear of intimidation, harassment or assault. We will not allow the anti-social behaviour of the minority to inflict fear and distress on the law abiding majority."
