Swithland Barn: Appeal Dismissed

PRESS STATEMENT BY CHARNWOOD BOROUGH COUNCIL:

In November 2008 the Council issued an Enforcement Notice in respect of an unauthorised building that was being erected on Main Street, Swithland. An appeal against this Notice which required the complete removal of the building was held at a Public Inquiry on 21 and 22 July.

The Inspector's decision is to dismiss the appeal. He concluded that the building is not reasonably necessary for the purposes of agriculture on the unit and that it has not been designed for the purposes of agriculture. For these reasons he dismissed the ground (c) appeal. He also concluded that the development has had an unacceptably adverse effect on the character and appearance of the area and is contrary to the relevant provisions of the development plan. The appeal on ground (a) has therefore failed and planning permission has not been granted. The Inspector found that the requirements of the Enforcement Notice were reasonable and therefore the appeal on ground (f) failed. The Inspector has agreed to extend the time period to comply with the Notice from 4 months to 8 months. This means that the building must be removed and the land re-instated by 25th April 2010.
